If you have the status of a real person acting on behalf of / authorized to represent our company’s customer(s) or supplier(s), or if you are our company’s employee or an “employee candidate” who applied to our company for employment; as İnergo Endustriyel Akustik İzo. İnş. San. Tic. Ltd. company which is duly founded in Turkey (hereinafter referred to as the “Company”), we hereby declare with the title of the Data Controller, that:
Your personal data that is obtained in the ways stated in this document can be recorded, stored, preserved, re-arranged in scope of our commercial relationships or business relationship with you, in scope of the goals that require them to be processed and in such a way limited to, connected to and restricted to such goals, as notified by us or as notified by you, by preserving the personal data integrity and actuality; and the data can also be shared with organizations which are legally authorized to request such personal data and also be transferred, handed over to or classified by domestic or foreign third parties as allowed by KVVK (Personal Data Protection Law), in addition to other ways and purposes as declared by KVKK legislation.
Our company places high importance on personal data security and this disclosure text has been prepared to declare and inform the related parties according to 6698 numbered Personal Data Protection Law and other related legislation.
As you know, 6698 numbered Personal Data Protection Law arranges the rules and liabilities required to be followed by the real persons or legal entities that process the personal data, in addition to the protection of the personal data.
This disclosure text is also prepared to inform the web site visitors to remind them of their rights based on 6698 numbered Personal Data Protection Law.

The processing of your personal data according to 6698 numbered Personal Data Protection Law and other related legislation include the processes, such as:

According to 6698 numbered Personal Data Protection Law and other related legislation, your personal data can be processed by your data controller İnergo Endustriyel Akustik İzo. İnş. San. Tic. Ltd. company. As the data controller, İnergo Endüstriyel Akustik İzo. İnş. San. Tic. Ltd. Şti. company shall be responsible from the establishment and management of the data recording system by determining the processing goals and methods of the personal data which is recorded on any medium including the database. The Data Controller registration shall immediately be done when the Data Controller Registry is opened.
THE GOAL OF PERSONAL DATA PROCESSING, AND ITS TRANSFER WHEN REQUIRED
As a Company, we collect the personal data to fulfill our legal liabilities, to perform contractual services, to purchase and sell the products and services offered by the company, to fulfill the liability to notify the law-enforcement officers in scope of our employees and to be able to open bank accounts.
We collect your personal data by requesting it from you because of the legal requirements to fulfill Company’s activities, by always placing the priority on your basic rights and freedoms, and we collect them when they are sent physically or electronically by you or third parties. We electronically collect your personal data with the help of the cookies used at our web site based on legitimate interests to make the services offered by the Company more effective and advanced.
The information collected about people who are younger than 18 years old is limited to the name, surname, age and degree of kinship, and this kind of data can only be provided by the related adults, which is required based on the legal requirements and the performance of the employment contracts of our employees. Your personal data is collected to carry out commercial activities in general sense, based on various legal reasons, by our company, through various methods and channels. Your personal data that is collected for legal reasons can be processed and transferred based on the personal data processing conditions and goals as stated in the 5th and 6th articles of 6698 numbered Personal Data Protection Law, based on the targets stated in the (b) and (c) clauses of this text.

• To carry out the job interviews and job placement activities for the employee candidates who make job applications, in scope of managing the human resources affairs,
• To contact you as a part of our company’s activities,
• To inform you about the important changes made in scope of the service conditions, the offered services, electronic systems or company contact information,
• To track the quality of the services offered by our Company, to analyze the training needs of our company’s human resources, to offer timely and correct services, to prevent unfair competition by ensuring our company’s commercial and financial security,
• To collect information or data about the subjects or people about whom complaints are made or to whom the complaints belong to, in order to solve the complaints regarding our company’s activities,
• To prevent illegal cases or situations, subject of which may constitute a crime,
• To carry out analyses to manage the obvious or immediate commercial risks,
• To be able to provide answers to the information demands made by the authorized governmental agencies or court authorities based on laws,
• To be able to keep the financial records to perform the commercial activities, to carry out independent audits and financial supervisions, to carry out accounting and financing processes, to issue invoices, to carry out collections,
• To fulfill the internal policies and procedures including those related to business continuity, record-keeping, document and print management as well as information processing systems, data and web site hosting,

4. SITUATIONS WHERE PERSONAL DATA CAN BE PROCESSED WITHOUT CONSENT

• The cases where the legislation clearly allows or the procedures as required to fulfill the related provisions of the legislation,
• In clearly compulsory cases such as health / security cases or protection of the right to live,
• The situations where the personal data is required to be processed by the direct parties of the contract, in order to perform any contract,
• To fulfill the legal liabilities,
• If the personal data is already made public beforehand, personally by the related person,
• If it is compulsory in order to establish, use or protect any constitutional/legal right,
• On condition that the related person’s basic rights and freedoms are not harmed, based on one of the reasons, where it is compulsory for the data controller to process the data for the legitimate interests,
• 4857 numbered Labor Law, 5510 numbered Law and other legislation provisions.
5. ABOUT TRANSFERRING YOUR PERSONAL DATA
We may share your personal data with domestic or foreign third parties in the belowmentioned cases:
• With our business partners, company authorities and shareholders within country and abroad, in order to carry out the company’s economic and administrational management works, by ensuring the legal and commercial security of the people with whom we have business relationship,
• With the law enforcement forces as required by the liabilities stated in the Identity Declaration Law,
• With hotel personnel so that the company’s activities can be carried out,
• With third party payment service providers such as the banks and credit card companies to carry out processes such as payment verification and completion,
• To track your steps when using the web site in order to provide better services; to recognize our customers, suppliers and people who make job applications, and in scope of the “Cookie Policy” at the address of third parties who manage the related activities within country and abroad,
• With our consultants and the related auditing companies, for the purposes of auditing and reporting our budget management, current card opening, invoicing etc. accounting and finance-related procedures, when your personal data is required to achieve such purposes,
• With third party archiving companies that offer services, to store the related records that contain your personal data throughout the storage period,
• With the related governmental institutions in scope of our liabilities to fulfill demands such as the court orders or the bills to perpetuate testimony, on condition that the legal requirements and principles are fulfilled and followed, and with our lawyers so that we can use our legal defense rights,
• We can share the personal data of people who make job applications or who work at our workplace, with our consultants who serve our company in scope of Labor Law and Social Security Institution processes, and only in scope of the related purposes.
• We can transfer the personal data of our employees to our customers within country or abroad, in order to achieve company’s economical and administrational management, by ensuring suitability to HSE specifications as well as occupational health and safety rules.
6. YOUR RIGHTS TO PROTECT YOUR PERSONAL DATA
You have the belowmentioned rights as the person/people, whose personal data is collected and processed in scope of the legislation:
6.1. You have the right to learn whether your personal data is processed or not.
6.2. You have right to demand the related information if your personal data is processed.
6.3. You have a right to learn the purpose of the processing of your personal data and whether they are used according to the stated goals or not.
6.4. You have the right to know the third parties within country and abroad, to whom the personal data is transferred, together with the reasons.
6.5. If the personal data is missing or wrongly processed, you have the right to request corrections to be made and to request notification of the third parties to whom such processed personal data is transferred, accordingly.
6.6. If the reasons that require your personal data to be processed exist no more, you have the right to request their erasure/destruction and the notification of the third parties to whom such processed personal data is transferred, accordingly.
6.7. You have the right to make an objection to the emergence of results against you, which is obtained after the processed data is analyzed exclusively through automated systems.
6.8. If your personal data is processed in ways against the legislation, you have a right to demand compensation if you are harmed because of that.
6.9. You always have the right to notify the company when you withdraw your consent, in scope of the cases which require your consent for personal data processes.
7. YOUR REQUESTS TO PROTECT YOUR PERSONAL DATA
You can send your requests to our company, by stating that you want to use your rights based on 1st paragraph of 13th article of 6698 numbered Personal Data Protection Law, in written form or via other methods as determined by the Personal Data Protection Board. The Personal Data Protection Board has currently determined no other methods, therefore we have explained the channels and methods to send your requests below.
You can send your request to use your rights stated in 11th article of 6698 numbered Personal Data Protection Law, together with the information that prove your identity, in order to use your abovementioned rights, by the methods listed below:
7.1. Electronic Application - The application can electronically be made through electronic application by filling the form at https://www.inergo.com.tr address,
7.2. Written Application By Filling The Form - You can send the “Personal Data Protection Request Form” with your wet signature, to our company’s Kavacık Mah. Fsm Cad. Şht. Üstğ. Önder Balkaya Sk. No:14/3 K.4 D.9 Beykoz / Istanbul address, 7.3 Through Notary Office - You can send a written notification to our company through notary office process.
If you inform our Company about your demands, as the Data Subject, based on our rights arising from the 6698 numbered Personal Data Protection Law, our Company shall conclude your request as soon as possible, but within 30 days at the latest. Depending on the nature of the request; our company may request the expenses for the documents if the expenses exceed 50 (fifty) TL regarding the costs of the requested information (mail, photocopies, notary office etc.).
8. OUR COMPANY’S COOKIE POLICY
As it is known, a “cookie”, which is a concept used in the field of informatics, is defined as a small text file which is used to store the data regarding web site visits on your PC, tablet, smart phone or other kind of devices.
